Distance Sales Agreement

ARTICLE - 1 SUBJECT

The subject of this agreement is the Seller's rights and rights to sell to the Buyer (the Consumer), the following qualifications and sales price related to the sale and delivery of the Consumer Protection Law No. 6502, related regulations and other legal provisions in accordance with the rights and obligations.


ARTICLE 2 - ESTABLISHMENT OF THE CONTRACT

2.1 The BUYER ACKNOWLEDGES THAT THE READING, UNDERSTANDING OF THE AGREEMENT, AND ITS CONSERVATION OF THEIR RIGHTS AND OBLIGATIONS.

2.2 THE SELLER AND THE BUYER HAVE NO PROPERTY BETWEEN THE CONTRACT AND THE ACTION AGREED BY THE CONTRACT.

2.3 THE PURCHASER WILL HAVE ANY CONSEQUENTIAL CONFIDENTIALITY THAT THE CONTRACTS CONTAINED IN THE SCOPE OF THE CONTRACT ARE SUITABLE FOR THEIR OWN BENEFIT, THOUGH AND WILL HAVE ANY COMPLETE, WITHOUT FREQUENCY OR CONSEQUENTIALITY IN ALL TERMS.

2.4 SELLER AND BUYER AGREES THAT THE TERMS OF THE CONTRACT ARE NOT INCREASED BY AN UNFORTABLE CONDITION, AND ARE NOT INITIAL IN TERMS OF THE BALANCE OF INTEREST.

2.5 REQUIREMENTS OF ARTICLE 6 OF THE REGULATION ON THE APPLICATION PROCEDURES AND PRINCIPLES REGARDING THE CAMPAIGN SALES PROVIDED WITHIN THE SCOPE OF THIS AGREEMENT, ANNEXES AND PROVIDED UNDER THE OPERATIONS THROUGH http://www.harsena.net.

2.6 THE PROVISIONS OF THIS AGREEMENT DO NOT CONTAIN ANY UNLAIMFUL CONDITIONS IN ACCORDANCE WITH THE REGULATIONS OF THE CONSUMER CONDITIONS IN THE CONSUMER CONTRACTS. PROVISIONS DO NOT CONSTITUTE INTEGRITY AND INTEGRITY, AND PREPARED IN ACCORDANCE WITH CONSUMER PROTECTION LEGISLATION.

2.7 THE PROVISIONS OF THIS AGREEMENT HAS BEEN PREPARED IN ACCORDANCE WITH THE PROVISIONS OF NEW DEBTS LAW NO. 6098. BINDING AND CONTENT INSPECTION PROVIDED IN ARTICLE 21 OF THE NEW DEBT LAW HAS BEEN MADE BY THE BUYER. THERE ARE NO PROVISIONS OF ANY OF THE PROVISIONS OF THIS AGREEMENT FOR THE QUALITY OF THE AGREEMENT AND THE CHARACTERISTICS OF THE AGREEMENT. THE TERMS OF THIS AGREEMENT ARE WRITTEN IN A CLEAR AND UNDERSTANDABLE WAY, AND DOES NOT EXPRESSLY MEAN WELL SINGLE MEANING.

ARTICLE 6 GENERAL PROVISIONS

6.1 The Purchaser declares that he has read and informed all the preliminary information regarding the basic characteristics, sales price and payment method and delivery of the product subject to the contract mentioned in Article 5 and has given the necessary confirmation in electronic environment.

6.2 The contracted product shall be delivered to the Purchaser or the person / organization at the address indicated within the period specified in the preliminary information, depending on the distance of the Buyer's place of residence for each product, provided that it does not exceed the legal 30-day period.

6.3 If the contracted product is to be delivered to another person / entity than the Buyer, the Seller shall not be held liable for the person / organization not accepting the delivery.

6.4 The Seller shall be responsible for the delivery of the contracted product in a sound, complete and in accordance with the qualifications specified in the order. The Seller may provide the Buyer with goods or services of equal quality and price before the expiry of the contractual obligation, provided that it is justified.

6.5 For delivery of the contracted product, this contract must be confirmed electronically and the price of the contracted order must be paid. If, for any reason, the product price is not paid or canceled in the bank records, the Seller shall be deemed free of the obligation to deliver the product.

6.6 If the Seller cannot deliver the contracted product within the due period due to force majeure or extraordinary conditions such as weather disruptions, interruption of transportation, the Seller is obliged to notify the Buyer. In this case, the Seller may exercise one of the rights to cancel the order, to replace the product of the contract subject with a precedent and / or to postpone the delivery time until the elimination of the blocking condition.

In case the seller cancels the order, the amount paid shall be returned to him within 10 days.


ARTICLE 7 RIGHT OF JUSTICE

Pursuant to the relevant provisions of the Law No. 6502 on Consumer Protection;

7.1 Consumer; has the right to withdraw from the contract in distant contracts regarding the sale of goods within fourteen days from the date of receipt of the goods without giving any reason and paying penalty. It is sufficient that the notification that the right of withdrawal is exercised is directed to the seller or provider within this period.

7.2 Unless otherwise agreed by the Parties, the Consumer shall not be entitled to withdraw from contracts in respect of the delivery of goods which are prepared in accordance with the wishes of the Consumer or clearly the personal needs of the Consumer, which are not conducive to being returned by nature and which may be in danger of deterioration rapidly or which may expire.

7.3 In the event that the Consumer uses his / her right of withdrawal, the Seller or provider shall return the total amount received within ten days from the date of receipt of the notification of cancellation and any document that puts the Consumer under debt without any expense and within twenty days. is obliged to take back the goods.

7.4 The decrease in the value of the goods received or the existence of a reason that makes it impossible to return does not preclude the exercise of the right of withdrawal. However, if the impairment or impossibility of return is due to the Consumer's defect, the Seller must compensate the merchant for the value or decrease in value. Changes and deteriorations that occur due to the usual use of the goods are not considered impairment.


ARTICLE 8 AUTHORIZED COURT

Any complaints and objections arising from this Agreement may be filed with the Consumer Problems Arbitral Tribunal or Consumer Court in the place where the Purchaser's or Seller's residence is located, in accordance with the monetary limits set by the relevant Ministry in December each year.


ARTICLE - 9 RETURN AND WARRANTY CONDITIONS

When receiving the cargo, check the inside of the parcel. If the products are damaged or missing, ask the cargo personnel to keep a report. Please note that the cargo personnel fulfills all responsibility for a delivered order.

You may use your right of exchange and return in case of an incorrect missing or defective product in the order you received. Pursuant to the TCC, there is no right of withdrawal for foodstuffs, drinks and other daily consumables. If you are dissatisfied with your order, you can email us at halitcelebi@harsena.net by specifying your order number.

You can return the product you received without opening the package, destroying it, using the product and after the delivery date within seven (7) days from the date of delivery in a way that will not prevent the sale of the product again. No refund will be made for product return transactions. If the ordered product defect is due to customer use or if the product has been used within 7 days, the product will not be returned and exchanged. As the product return and replacement conditions, practices are essential in accordance with the Law No. 4077 on Consumer Protection.

Refund is not accepted for products that must be stored and shipped in the cold chain.


ARTICLE 10 DELIVERY INFORMATION

Your orders will be shipped within 2 business days (Monday-Friday) after bank approval. Depending on the distance of your delivery address to Amasya, the cargo company will deliver your order within 1-3 days.

In case of a mishap caused by us, you will be informed based on your membership information. That's why membership is complete and accurate information is important. Delivery is not done on weekends and feast days.

You will be notified with a confirmation e-mail. If any of the products you have chosen is not available in stock, an email will be sent to you and you will be notified of the date when the product will first enter the stock.
